Mesa by Sidewalk Labs - Privacy Statement

This Privacy Statement explains how your personal information is collected and used by Sidewalk Labs LLC, Google LLC and respective subsidiaries or affiliates (together, “we”, “our”, or “us”) when you use the Mesa by Sidewalk Labs App (the “Mesa App” or “App”), the Mesa by Sidewalk Labs Dashboard (the “Dashboard”), and associated online services (“Online Services”) in connection with the services provided by us to the entity or other organization that has entered into an agreement with us for use of its services (“Customer”).

Collection of Information

Information Your Office Administrators or You Provide to Us We collect information that you or your Office Administrators provide to us, including:

  • Your name and work email address, which your Office Administrators input into an Administration Tool for the App or the Dashboard. We collect this information so that we can enable you to access the App or the Dashboard. Each time you log into the App or the Dashboard, we may collect your work email address so that we can enable your log in.
  • A profile that you can create, and may include your name, gender (optional), working location in the workspace (optional) and temperature preferences (optional). We collect this information to customize how you interact with the App or the Dashboard.
  • Temperature feedback that you provide on different areas in your workspace. We collect this information to help optimize energy use and provide more comfortable temperatures in your workspace.

Information We Collect Automatically

The Mesa App is designed to work with the Mesa (by Sidewalk Labs) product, which helps reduce energy use and improve temperature comfort in offices. Mesa includes various devices that collect data or provide opportunities for you to provide feedback on the temperature, and which may be installed in your workspace. These devices do not collect identifying information. For example, they may collect data on the temperature in an area of the workspace, whether an area is empty or occupied, how much energy being used by a plug load, whether a window is open or closed, or manual feedback on the temperature in an area of the workspace.

When you use the App or the Dashboard, we may automatically collect information, including personal information, such as:

  • Log Information: We may collect log information about your use of the App or the Dashboard, including login time, the type of browser you use, access times, and pages viewed.
  • Information Collected by Cookies: We may use cookies, small data files stored in your device’s memory, to help us improve the App, the Dashboard, the Online Services, and your experience. We may also use them to help us understand which areas and features of the App are popular.
  • Analytics Services Provided by Others
  • In connection with the use of the App and the Dashboard, we may allow others to provide analytics services, such as Google Analytics. These entities may use cookies, web beacons, and other technologies to collect information about your use of the App, the Dashboard, web browser, device, pages viewed, time spent on pages, and links clicked. This information may be used by us and others to, among other things, analyze and track data, determine the popularity of certain content and better understand your online activity. Use of Information

We may use the collected information to:

  • Enable you to access the App or the Dashboard and log into the app
  • Customize your interactions with the App or the Dashboard
  • Provide and improve the App, the Dashboard, the Mesa product and to develop new apps, products and services;
  • Reply to your questions or feedback;
  • Help control and advise on temperature settings and energy use;
  • Help workspaces improve energy efficiency and achieve sustainability goals;
  • Identify areas that may align with your occupancy and/or temperature preferences;
  • Monitor and analyze trends, usage, and activities in connection with the use of the App, the Dashboard, and Online Services; and
  • Produce aggregated, anonymous data reports, which may be shared with others.

We may also use your personal information as otherwise permitted or as required by law. We will ask for your consent before using your personal information for a materially different purpose not covered in this Privacy Statement. When we solicit additional information from you we will provide information to you at the time about the purposes for which the additional information is being collected, used or disclosed. We will retain your personal information for as long as reasonably necessary to fulfill the purposes for which it was collected and as required by law.

Sharing of Information

Information you submit via the App or Dashboard may be accessed by your employer. We do not disclose your personal information to third parties unless we have your consent or we are required to do so by law. We use reasonable measures to keep your personal information safe.

Transfer of Information to Other Countries

Your personal information and other information may be transferred to and held in the United States, where it will be subject to United States laws, when there is a justifiable reason to do so. Your Access and Correction Rights

You can request access to, or correction of, your personal information by contacting swl-privacy-contact@google.com. We will promptly respond to your request unless we are prohibited to do so by law or another exception applies. In that case we will justify our refusal.
